Terms of Service

By accessing, browsing, or otherwise using the Arthyion platform, website, and any associated services (collectively, "the Service"), you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms in their entirety, you must immediately discontinue access to and use of the Service. Your continued use of the Service following the posting of any changes to these Terms constitutes binding acceptance of those changes.

These Terms constitute a binding legal agreement between you ("User," "you," or "your") and Arthyion ("we," "us," or "our"). These Terms govern your access to and use of the Service and all content, features, functionality, and applications offered by Arthyion.

Arthyion is an online entertainment discovery and aggregation platform that provides users with access to information, metadata, and curated links to movies, television shows, live sports events, and user-generated live streams. The Service operates as follows:

• Video Content: Arthyion does not host, store, upload, or transcode video files on its own servers. All video playback is provided through third-party embedding partners including but not limited to Videasy, VidKing, and Streamed.pk. These providers operate independently of Arthyion.
• Metadata: Movie and TV show information, posters, descriptions, ratings, and cast information is sourced from The Movie Database (TMDB) under their API terms. All TMDB data belongs to its respective contributors.
• Sports Data: Live sports stream data and match information is sourced from third-party sports API providers. Availability may vary by region and event.
• Live Streaming: User-generated live streams are hosted via Cloudflare Stream infrastructure. Stream availability is subject to Cloudflare's terms and infrastructure capacity.
• AI Features: AI-powered features including movie recommendations and chat assistants are powered by Anthropic's Claude API and Cloudflare AI. These features are provided as-is and may produce imperfect results.

The availability, quality, and completeness of the Service may vary based on your geographic location, network conditions, device capabilities, and the availability of third-party services upon which Arthyion depends.

Age Requirement: You must be at least 13 years of age to create an account or use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly collect data from children under 13, and any such accounts discovered will be immediately terminated.

Account Accuracy: When you create an account, you agree to provide accurate, current, and complete information. You must keep your account information updated to ensure it remains accurate and complete at all times.

Account Security: You are solely responsible for maintaining the confidentiality of your account credentials, including your password and any linked OAuth tokens. You agree to:

• Choose a strong, unique password not used on other services
• Never share your account credentials with any third party
• Immediately notify us of any unauthorized access to your account at kyattou@arthyion.com
• Log out from shared or public devices after each session
• Not allow any other person to use your account under any circumstances

Arthyion cannot and will not be liable for any loss or damage arising from your failure to comply with these account security obligations. You acknowledge that Arthyion is not responsible for unauthorized access to your account resulting from your actions or negligence.

One Account Per User: Unless expressly authorized by Arthyion, each user is permitted to maintain only one primary account. The account switching feature is provided for convenience between linked accounts, not to circumvent account limitations.

Subscription Plans: Arthyion offers a premium subscription tier called "Arthyion+" that unlocks additional features, higher quality streams, and exclusive content access. Current pricing is $7.99/month, though pricing may change with notice.

Invite Codes: Arthyion+ access may also be granted via invite codes distributed by Arthyion or its affiliates. Invite codes have no cash value, cannot be transferred, and expire if not redeemed within the specified timeframe.

Premium Features: Arthyion+ subscribers receive access to features including but not limited to: premium content marked with the Arthyion+ badge, higher resolution streams where available, priority access to new features, and expanded Watch Party capabilities. Features available under Arthyion+ may change over time.

Subscription Revocation: We reserve the right to revoke Arthyion+ access without refund if:

• You share your subscription or credentials with others
• You violate any provision of these Terms of Service
• You engage in fraudulent activity related to the subscription
• Your account is banned or terminated for any reason

No Refunds: All subscription fees are non-refundable unless otherwise required by applicable law. If your subscription is revoked due to a Terms violation, no refund will be issued.

You agree to use the Service only for lawful purposes and in accordance with these Terms. Specifically, you agree that you will not:

• Use the Service for any purpose that violates any applicable local, national, or international law or regulation
• Attempt to gain unauthorized access to any portion of the Service, other accounts, or systems connected to the Service
• Use automated bots, scrapers, crawlers, or scripts to access, collect, or interact with the Service without express written permission
• Share, sell, or transfer your account credentials or session tokens to third parties
• Circumvent, disable, or interfere with security-related features of the Service, including content protection mechanisms
• Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Engage in any activity that disrupts, damages, or impairs the integrity or performance of the Service
• Attempt to probe, scan, or test the vulnerability of the Service or any associated systems
• Engage in reverse engineering, decompiling, or disassembling any part of the Service
• Use the Service to send unsolicited communications (spam) to other users
• Impersonate any person or entity or falsely represent your affiliation with any person or entity
• Use the Service in a manner that could create a disproportionately large load on our infrastructure

We reserve the right to investigate and take appropriate legal and technical action against anyone who, in our sole discretion, violates this Acceptable Use Policy, including removing content, terminating accounts, and reporting to law enforcement authorities.

Third-Party Content: All video content accessible through the Service is provided by third-party embedding services. Arthyion does not claim ownership, control, or endorsement of any third-party content accessible through embedded players. The legality, availability, and accuracy of third-party content is the sole responsibility of the respective providers.

Metadata: Movie and TV show metadata (titles, descriptions, posters, cast information, ratings) is sourced from The Movie Database (TMDB) API. This data is the property of TMDB and its contributors and is used in accordance with TMDB's API terms of service. Arthyion makes no warranties regarding the accuracy or completeness of TMDB metadata.

DMCA & Copyright Compliance: Arthyion respects intellectual property rights and expects users to do the same. If you believe that any content accessible through the Service infringes your copyright, please contact us at kyattou@arthyion.com with the following information:

• A physical or electronic signature of the copyright owner or authorized agent
• Identification of the copyrighted work claimed to be infringed
• Identification of the material claimed to be infringing and its location on the Service
• Your contact information including address, telephone number, and email
• A statement of good faith belief that the use is not authorized by the copyright owner
• A statement of accuracy and authorization under penalty of perjury

We will respond to valid DMCA notices in a timely manner and take appropriate action as required by law.

User-Generated Content: The Service allows users to communicate via Watch Party chat. You retain ownership of any content you submit, but by submitting content, you grant Arthyion a worldwide, non-exclusive, royalty-free license to use, display, and transmit that content in connection with operating the Service.

Content Standards: All content you submit in chat must comply with our Acceptable Use Policy. Specifically prohibited in community features:

• Harassment, bullying, threats, or intimidation of other users
• Hate speech targeting individuals or groups based on protected characteristics
• Sharing personally identifiable information about others without their consent
• Sexual content, nudity, or explicit material
• Spam, repetitive messages, or flooding
• Links to malicious content, phishing sites, or harmful software
• Impersonating other users, staff, or public figures

Moderation: Arthyion and its administrators reserve the right to remove any user-generated content and to terminate the accounts of repeat violators without warning or refund. We are not obligated to monitor all content but may do so at our discretion.

Party Codes: Watch Party codes are 6-character alphanumeric codes with a 6-hour expiration. Party hosts are responsible for all activity within their Watch Party session. Arthyion is not responsible for content shared or discussed during Watch Party sessions.

Streamer Eligibility: Live streaming capabilities are restricted to users who have been granted streamer access by Arthyion administrators. Streamer access may be granted or revoked at any time at our sole discretion.

Streamer Responsibilities: If granted streamer access, you agree to:

• Stream only content you have the rights to broadcast, including complying with all applicable copyright, music licensing, and broadcasting laws
• Not stream content that violates our Acceptable Use Policy
• Not stream content that is illegal, harmful, or violates any third-party rights
• Clearly label your streams accurately with appropriate titles and categories
• Not use the streaming infrastructure for any commercial purpose without written permission

Infrastructure: Live streaming is powered by Cloudflare Stream. Stream quality, latency, and availability are subject to Cloudflare's infrastructure and are outside Arthyion's direct control. We make no guarantees regarding stream uptime, latency, or recording availability.

Content Removal: Arthyion reserves the right to terminate any live stream at any time without notice if it violates these Terms or if we receive complaints from third parties regarding the stream content.

Our Rights: Arthyion reserves the right, in our sole and absolute discretion, to suspend, ban, or terminate any account at any time, for any reason or no reason, with or without notice, and with or without refund of any subscription fees paid.

Grounds for Termination: Accounts may be terminated for reasons including but not limited to:

• Violation of any provision of these Terms of Service
• Engaging in fraudulent, abusive, or harmful behavior toward other users or the platform
• Providing false or misleading information during registration
• Repeated violations of community standards
• Engaging in activity that poses legal risk to Arthyion or its users
• Inactivity for an extended period (we reserve the right to reclaim inactive accounts)

Effect of Termination: Upon account termination, your right to access and use the Service immediately ceases. All data associated with your account may be permanently deleted. Arthyion has no obligation to provide you with your data upon termination.

Appeals: If you believe your account was banned in error, you may contact us at kyattou@arthyion.com to request a review. We will review appeals at our discretion; our decision on all appeals is final.

Disclaimer of Warranties: THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

Arthyion does not warrant that: (a) the Service will function uninterrupted, securely, or be available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; (d) the results of using the Service will meet your requirements.

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ARTHYION, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, trojan horses, or similar transmitted through the Service
• Any errors or omissions in any content or for any loss or damage incurred through use of any content posted, transmitted, or otherwise made available through the Service

Indemnification: You agree to defend, indemnify, and hold harmless Arthyion and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

Arthyion reserves the right to modify, update, or replace these Terms at any time at our sole discretion. We will provide notice of material changes by updating the "Last updated" date at the top of this page and, where feasible, by posting a notice within the Service.

Your continued use of the Service after any changes to these Terms constitutes your binding acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service. We encourage you to review these Terms periodically to stay informed about your rights and obligations.

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of competent jurisdiction.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect. The failure of Arthyion to enforce any right or provision of these Terms will not be considered a waiver of those rights.
