ARTHYION

1.1 Agreement Scope

These Terms apply to all users of the Platform, including but not limited to:

• • Casual players and visitors
• • Competitive ranked players
• • Tournament participants
• • Content creators and streamers
• • Community moderators

1.2 Additional Terms

Certain Platform features may be subject to additional terms and conditions, which will be presented to you at the time of use. Such additional terms are incorporated by reference into these Terms.

2.1 Minimum Age

You must be at least 13 years of age to create an account and use the Platform. If you are between 13 and 18 years of age (or the age of legal majority in your jurisdiction), you may only use the Platform under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

2.2 Parental Consent

Parents or legal guardians who permit minors under their supervision to use the Platform agree to:

• • Exercise supervision over the minor's online activities
• • Assume full responsibility for the minor's compliance with these Terms
• • Be liable for any violations or damages caused by the minor's use

2.3 Geographic Restrictions

The Platform is operated from the United States. We make no representation that the Platform is appropriate or available for use in other locations. Users accessing the Platform from other jurisdictions do so at their own risk and are responsible for compliance with local laws.

3.1 Account Creation

To access certain features, you must create an account by providing accurate, current, and complete information. You agree to:

• • Provide truthful and accurate registration information
• • Maintain and promptly update your account information
• • Maintain the security of your password and account credentials
• • Notify us immediately of any unauthorized access or security breach
• • Accept responsibility for all activities occurring under your account

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials. We recommend using strong, unique passwords and enabling any available security features. You must not share your account with others or allow others to access your account.

3.3 Username Policy

Your username must not:

• • Contain profanity, hate speech, or offensive language
• • Impersonate any person or entity
• • Infringe on intellectual property rights
• • Contain URLs or promotional content
• • Be intentionally confusing or misleading

We reserve the right to modify or remove usernames that violate this policy.

3.4 Account Transfers

Accounts are non-transferable. You may not sell, trade, gift, or otherwise transfer your account to any other person or entity. Any attempted transfer will result in immediate account termination.

4.1 Prohibited Activities

• • Harassment, bullying, or intimidation of other users
• • Use of hate speech, discriminatory language, or threats
• • Posting or sharing sexually explicit, violent, or disturbing content
• • Impersonating other users, moderators, or Arthyion staff
• • Spamming, flooding, or excessive self-promotion
• • Sharing personal information of others without consent (doxxing)
• • Creating multiple accounts to circumvent restrictions or bans
• • Encouraging or facilitating rule violations by others

4.2 Technical Violations

You must not:

• • Attempt to gain unauthorized access to Platform systems or data
• • Interfere with or disrupt Platform functionality or servers
• • Use automated scripts, bots, or crawlers without permission
• • Reverse engineer, decompile, or disassemble Platform software
• • Exploit bugs, glitches, or vulnerabilities for unfair advantage
• • Distribute malware, viruses, or harmful code
• • Circumvent any security or access control mechanisms

4.3 Fair Play Expectations

All users must compete fairly and honestly. You agree to:

• • Type all content manually without automation or assistance
• • Not use external programs or hardware to enhance performance
• • Not collude with other players to manipulate rankings or outcomes
• • Report suspicious activity or rule violations to moderators
• • Cooperate with investigations into potential violations

5.1 Cheating and Exploitation

The following actions constitute cheating and will result in immediate account termination:

• • Using typing assistance software, macros, or automation tools
• • Employing external devices designed to artificially enhance performance
• • Copy-pasting text or using predictive text features
• • Intentionally exploiting bugs or glitches for competitive advantage
• • Account sharing to allow others to compete on your behalf
• • Win-trading or intentionally losing matches to manipulate rankings

5.2 Detection Systems

We utilize advanced anti-cheat technology including:

• • Statistical analysis of typing patterns and performance metrics
• • Input timing validation and keystroke analysis
• • Behavioral pattern recognition algorithms
• • Community reporting and manual review by moderators

By using the Platform, you consent to these monitoring and detection processes.

5.3 Ranked Play Requirements

Participation in ranked competitive modes requires:

• • Verified email address on your account
• • Minimum account age of 7 days
• • Completion of at least 10 practice matches
• • Compliance with all conduct and fair play policies

5.4 Appeals Process

If you believe you have been wrongly flagged or penalized, you may submit an appeal within 14 days by contacting appeals@arthyion.com. All appeals are reviewed by senior staff members. Our decisions on appeals are final.

6.1 Platform Ownership

All rights, title, and interest in and to the Arthyion Platform, including all content, features, functionality, software, code, designs, graphics, interfaces, trademarks, service marks, and logos are owned by Arthyion and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Limited License

Subject to your compliance with these Terms, Arthyion grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

• • Access and use the Platform for personal, non-commercial purposes
• • Display Platform content on your personal devices
• • Create derivative works only as explicitly permitted by Platform features

This license does not grant you any rights to use Arthyion trademarks, logos, or brand elements without prior written consent.

6.3 Content Sources

Typing practice texts and passages on the Platform are sourced from:

• • Public domain works and literature
• • Original content created by Arthyion
• • Licensed content from third-party providers
• • User-submitted content (see Section 7)

All content is used in accordance with applicable copyright laws and licenses.

6.4 Restrictions

You may not:

• • Copy, modify, or distribute Platform content without authorization
• • Create derivative works based on the Platform
• • Use the Platform for commercial purposes without written agreement
• • Remove or alter any copyright, trademark, or proprietary notices
• • Frame or mirror any part of the Platform

7.1 User-Generated Content

The Platform may allow you to create, submit, or share content including custom typing texts, profile information, forum posts, or other materials ("User Content"). You retain ownership of your User Content, but grant Arthyion specific rights as described below.

7.2 License Grant

By submitting User Content, you grant Arthyion a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to:

• • Use, reproduce, distribute, and display your User Content on the Platform
• • Modify or adapt User Content to ensure compatibility with Platform features
• • Create derivative works for Platform improvement and promotion
• • Sublicense User Content to other users for practice purposes

This license continues until you delete the content or terminate your account, though copies in backup systems may persist for reasonable periods.

7.3 Content Standards

All User Content must comply with these standards:

• • You must own or have rights to submit the content
• • Content must not violate copyright, trademark, or other IP rights
• • Content must not contain illegal, harmful, or offensive material
• • Content must be appropriate for users of all ages
• • Content must not contain advertising or promotional material

7.4 Moderation Rights

Arthyion reserves the right to:

• • Review and monitor User Content at any time
• • Remove or modify content that violates these Terms
• • Refuse to publish or distribute any User Content
• • Take appropriate action against users who violate content standards

We are not obligated to monitor User Content but may do so to maintain Platform quality and safety.

8.1 Service Availability

We strive to maintain Platform availability 24/7, but we do not guarantee uninterrupted access. The Platform may be temporarily unavailable due to:

• • Scheduled maintenance and updates
• • Emergency repairs or security patches
• • Force majeure events beyond our control
• • Technical failures or infrastructure issues
• • Third-party service disruptions

We will provide advance notice of scheduled maintenance when possible.

8.2 Service Modifications

Arthyion reserves the right to modify, suspend, or discontinue any aspect of the Platform at any time, with or without notice. This includes:

• • Adding, removing, or modifying features and game modes
• • Changing ranking systems or competitive algorithms
• • Adjusting content libraries and typing exercises
• • Implementing new policies or rule changes

We are not liable for any modifications to the Platform or temporary unavailability of services.

8.3 Third-Party Services

The Platform may integrate with or link to third-party services, websites, or content. These third parties are not under our control, and we are not responsible for their content, privacy practices, or terms of service. Your use of third-party services is at your own risk.

8.4 Beta Features

We may occasionally offer beta or experimental features. These features are provided "as-is" and may contain bugs or errors. We may modify or discontinue beta features at any time without notice. Your use of beta features is voluntary and at your own risk.

9.1 Free Services

Core Platform features are provided free of charge, including:

• • Account creation and basic profile features
• • Access to practice modes and bot training
• • Participation in ranked and quick play matches
• • Basic statistics and performance tracking
• • Community features and leaderboards

9.2 Premium Features (Future)

We may introduce optional premium features in the future, which may include:

• • Advanced analytics and detailed performance insights
• • Exclusive cosmetic items and profile customization
• • Priority matchmaking and server access
• • Custom practice content creation tools
• • Tournament entry fees and prize competitions

All premium features will be clearly marked, and you will be notified of costs before making any purchase. Premium features do not provide competitive advantages in gameplay.

9.3 Payment Terms

If you choose to purchase premium features:

• • All prices are in USD unless otherwise stated
• • You must provide accurate billing information
• • Payments are processed securely through third-party providers
• • All sales are final unless otherwise specified
• • Subscriptions auto-renew unless canceled before renewal date
• • You are responsible for all taxes associated with purchases

9.4 Refund Policy

Refunds may be granted at our discretion in the following circumstances:

• • Technical errors resulting in duplicate charges
• • Unauthorized transactions reported within 48 hours
• • Service failures preventing access to purchased features

Refund requests must be submitted to billing@arthyion.com within 14 days of purchase.

9.5 Virtual Items

Any virtual items, currencies, or cosmetics purchased have no real-world value and cannot be exchanged for cash or transferred outside the Platform. We reserve the right to modify or discontinue virtual items with reasonable notice.

10.1 Termination by User

You may terminate your account at any time by:

• • Using the account deletion feature in settings
• • Contacting support at support@arthyion.com

Upon termination, your account data will be deleted within 90 days, except where retention is legally required. Rankings and historical statistics may be retained for competitive integrity purposes.

10.2 Termination by Arthyion

We reserve the right to suspend or terminate your account immediately, without prior notice, if:

• • You violate any provision of these Terms
• • You engage in fraudulent or illegal activity
• • You use cheating or automation tools
• • You harass or abuse other users or staff
• • Your account remains inactive for over 2 years
• • We determine termination is necessary for legal or security reasons

10.3 Effects of Termination

Upon termination of your account:

• • You immediately lose access to all Platform services
• • Your license to use the Platform is revoked
• • Virtual items, currencies, and purchases are forfeited without refund
• • Outstanding payment obligations remain due
• • Sections of these Terms that by nature should survive will remain in effect

11.1 No Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARTHYION DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• • Warranties of merchantability, fitness for a particular purpose, and non-infringement
• • Warranties regarding accuracy, reliability, or completeness of content
• • Warranties that the Platform will be uninterrupted, secure, or error-free
• • Warranties that defects will be corrected
• • Warranties regarding results obtained from Platform use

11.2 User Responsibility

You acknowledge and agree that:

• • Your use of the Platform is at your sole risk
• • You are responsible for your interactions with other users
• • We do not verify user identities or background check users
• • You should exercise caution when sharing personal information
• • You are responsible for maintaining appropriate data backups

11.3 Third-Party Content

We do not control, endorse, or assume responsibility for any third-party content, websites, products, or services accessed through the Platform. Any reliance on such content is at your own risk.

11.4 Health Considerations

Extended typing sessions may lead to repetitive strain injuries. We recommend:

• • Taking regular breaks during use
• • Maintaining proper posture and ergonomics
• • Consulting medical professionals if experiencing discomfort

We are not responsible for any physical injuries or health issues arising from Platform use.

12.1 General Limitation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ARTHYION, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

• • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• • ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL
• • ANY DAMAGES RESULTING FROM UNAUTHORIZED ACCESS OR DATA BREACHES
• • ANY DAMAGES ARISING FROM SERVICE INTERRUPTIONS OR DELETIONS
• • ANY DAMAGES FROM USER CONDUCT OR USER-GENERATED CONTENT
• • ANY DAMAGES FROM RELIANCE ON PLATFORM CONTENT OR FEATURES

12.2 Maximum Liability

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF:

• • $100 USD, OR
• • The amount you have paid to Arthyion in the 12 months preceding the claim

12.3 Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

12.4 Basis of the Bargain

You acknowledge that these limitations of liability are fundamental elements of the agreement between you and Arthyion, and that we would not provide the Platform without these limitations.

13.1 Informal Resolution

Before initiating formal legal proceedings, you agree to attempt to resolve any dispute informally by contacting us at legal@arthyion.com with a detailed description of the dispute. We will attempt to resolve the dispute within 30 days of receiving notice.

13.2 Binding Arbitration

If informal resolution fails, any dispute arising from these Terms or the Platform shall be resolved through binding arbitration, except that:

• • You may bring claims in small claims court if they qualify
• • Either party may seek injunctive relief in court for intellectual property violations

Arbitration shall be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitrator's decision is final and binding, and judgment may be entered in any court of competent jurisdiction.

13.3 Class Action Waiver

YOU AND ARTHYION AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

13.4 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

13.5 Venue

To the extent any legal action is permitted under these Terms, you agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Delaware.

14.1 Modification Rights

We reserve the right to modify these Terms at any time. When we make changes, we will:

• • Update the "Effective Date" at the top of this document
• • Notify you via email if you have provided one
• • Display a prominent notice on the Platform
• • Provide a summary of material changes when significant

14.2 Acceptance of Changes

Your continued use of the Platform after Terms modifications become effective constitutes acceptance of the revised Terms. If you do not agree to the modified Terms, you must immediately stop using the Platform and may terminate your account.

14.3 Material Changes

For material changes that significantly affect your rights or obligations, we will provide at least 30 days' notice before the changes take effect. Material changes may include modifications to:

• • Dispute resolution procedures
• • Liability limitations
• • Payment terms or pricing structures
• • Data usage and privacy practices

15.1 Entire Agreement

These Terms, together with our Privacy Policy and any additional terms you agree to, constitute the entire agreement between you and Arthyion regarding the Platform and supersede all prior agreements and understandings.

15.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Arthyion.

15.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may freely assign these Terms without restriction. Any attempted assignment in violation of this section is void.

15.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

15.6 Survival

The following sections shall survive termination of these Terms: Intellectual Property, User Content (license grant), Disclaimers, Limitation of Liability, Dispute Resolution, and General Provisions.

15.7 Language

These Terms may be translated into other languages for convenience. In the event of any conflict between the English version and a translated version, the English version shall prevail.
